Capital Group Ventures (“Capital Group Ventures,” “CGV,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, and share information when you visit capitalgroupusa.com (the “Site”) or otherwise interact with us.
This Privacy Policy applies to information collected through the Site and through your communications and dealings with us in connection with our business. It does not apply to information governed by a separate agreement between you and CGV, or to the privacy practices of the third-party websites, platforms, and services described in Section 5.
Please read this policy carefully. If you do not agree with it, please do not use the Site.
1. Information We Collect
Information you give us. We collect information you choose to provide, for example when you:
- Fill out a contact or inquiry form
- Sign up for a newsletter or email updates
- Ask about a project, leasing, partnership, or investment opportunity
- Contact us by email or phone
- Provide information in connection with a project, lease, financing, acquisition, or investment, including as part of due diligence
Depending on how you interact with us, the information you provide may include: identifying and contact information (such as your name, email address, mailing address, telephone number, and the company or entity you represent); professional or commercial information (such as your title, the nature of your inquiry, and details about a project, property, lease, or transaction); and the contents of your communications with us. If you choose to send us financial, transactional, or other sensitive details in connection with a potential deal, we will treat that information in accordance with this policy and any applicable agreement between us.
Information we collect automatically. When you visit the Site, we and our service providers may automatically collect certain technical information, such as your IP address, browser type, device type, pages viewed, the site you came from, and the dates and times of your visits. We collect this through cookies and similar technologies (see Section 4).
We do not intentionally collect Social Security numbers, financial account numbers, government identification numbers, or other sensitive personal information through the Site’s public forms, and we ask that you not submit such information through those forms. Sensitive information exchanged in the course of a specific transaction is handled under the terms of that engagement.
2. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and requests
- Send you newsletters, updates, or marketing communications you have requested
- Operate, maintain, and improve the Site
- Understand how visitors use the Site
- Protect the security and integrity of the Site
- Evaluate, negotiate, and administer projects, leases, financings, acquisitions, investments, and other business relationships
- Comply with legal obligations
We do not sell your personal information, and we do not share it for cross-context behavioral (targeted) advertising, as those terms are defined under applicable state privacy laws. We will not use the information you provide for materially different, unrelated, or incompatible purposes without providing you notice.
3. How We Share Your Information
We share personal information only as described in this section, and only with parties that have a legitimate need for it in connection with the purposes described in this policy. We do not sell your personal information.
- Service providers. We share information with vendors and service providers who perform services on our behalf, such as website hosting, data storage, email and newsletter delivery, customer-relationship management, and analytics. These providers are authorized to use the information only as necessary to perform services for us and are contractually required to protect it and not to use it for their own purposes.
- Project and development partners. We develop and manage projects together with co-developers, joint-venture partners, property owners, lenders, brokers, contractors, and similar counterparties. If you contact us about a specific project, property, lease, financing, or investment, we may share your inquiry and contact details with the partner or counterparty responsible for that matter so that they, or we, can respond to you. We share only the information reasonably necessary for that purpose.
- Governmental and public agencies. Certain of our projects involve public-private partnerships, permitting, land use, or other dealings with municipalities, authorities, and other governmental bodies. Where your inquiry relates to such a project, or where doing so is necessary to pursue, negotiate, or administer the project, we may share relevant information with the applicable public agency. Information submitted to, or held by, a governmental body may also be subject to public-records or open-government laws that are outside our control. Separately, we may disclose information to governmental authorities where required by law, as described below.
- Professional advisors. We may share information with our attorneys, accountants, auditors, insurers, and other professional advisors where reasonably necessary to obtain their services, subject to appropriate confidentiality obligations.
- Affiliates. We may share information among CGV’s affiliated and related entities for the purposes described in this policy.
- Legal and safety reasons. We may access, preserve, and disclose information if we believe in good faith that doing so is required or permitted by law, subpoena, court order, or other legal process, or is reasonably necessary to enforce our agreements, respond to claims, protect the rights, property, or safety of CGV, our clients, users, or others, or detect and prevent fraud, security, or technical issues.
- Business transfers. If we are involved in or explore a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be disclosed to prospective or actual counterparties and their advisors, and may be transferred as part of that transaction, subject to reasonable confidentiality protections.
- With your direction or consent. We may share information in other ways at your direction or with your consent.
4. Cookies and Tracking Technologies
The Site uses cookies and similar technologies to function properly, remember your preferences, and understand how the Site is used. You can control cookies through your browser settings. Disabling cookies may affect how the Site works.
5. Third-Party Links
The Site may contain links to third-party websites, embedded maps, videos, or social media. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.
6. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We limit access to personal information to those who need it to carry out the purposes described in this policy. Despite these measures, no website, electronic transmission, or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any credentials you use in connection with us confidential.
7. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy — including to respond to your inquiries, maintain our business and project records, and pursue or administer transactions — and thereafter as needed to comply with our legal, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we take reasonable steps to delete, de-identify, or securely retain it.
8. Your Choices
- Marketing emails. You can opt out of marketing emails at any time using the unsubscribe link in the email or by contacting us.
- Cookies. You can manage cookies through your browser settings.
Do Not Track. Some browsers offer a “Do Not Track” setting. Because there is not yet a common industry standard for how to respond to these signals, the Site does not currently respond to them. We describe the choices available to you in this policy and in Section 10.
Depending on where you live, you may have additional rights over your personal information, such as the right to access, correct, delete, or obtain a copy of it. See Section 10 for details, or contact us using the information in Section 14.
9. Children’s Privacy
The Site is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13.
10. State Privacy Rights
Depending on your state of residence, and subject to the exceptions and limits in the applicable law, you may have some or all of the following rights regarding the personal information we hold about you:
- The right to know or access the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it;
- The right to correct inaccurate personal information;
- The right to delete personal information we have collected from you;
- The right to obtain a copy of your personal information in a portable format;
- The right to opt out of the sale of your personal information, the sharing of it for targeted or cross-context behavioral advertising, and certain profiling. As noted above, we do not sell your personal information or share it for these purposes; and
- The right to be free from discrimination for exercising any of these rights.
How to exercise your rights. You may submit a request by contacting us using the information in Section 14. We will need to verify your identity before responding, which may require you to provide information that reasonably confirms you are the person about whom we collected the information (or an authorized agent acting on that person’s behalf). We will not require you to create an account with us in order to make a request.
Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of your authorization and may separately verify your identity.
Our response and appeals. We will respond to verifiable requests within the time period required by applicable law. If we decline to act on your request, we will explain why, and, where the applicable law provides a right to appeal, we will tell you how to do so. We may decline a request, in whole or in part, where an exception under applicable law applies.
A note on scope. State privacy laws differ, and several apply only to businesses that meet specific revenue, data-volume, or other thresholds, or that exclude certain categories of information (for example, information regulated by other laws). The rights available to you, and the extent to which these laws apply to CGV, depend on your state of residence and the nature of the information at issue. We honor the rights described above to the extent the applicable law requires. Nothing in this section creates rights beyond those provided by applicable law.
California residents. If you are a California resident, you may also have the right to request the categories of personal information we disclosed for a business purpose. We do not sell or share (as those terms are defined under California law) the personal information of any consumer, and we have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age.
11. International Visitors
The Site is operated in the United States and is intended for users located in the United States. If you access the Site or contact us from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your country. By using the Site or contacting us, you consent to that transfer and processing.
12. Financial and Transaction Information
Some of our activities involve financial products or transactions. To the extent any information we collect from you is nonpublic personal information governed by the Gramm-Leach-Bliley Act or other financial-privacy laws, that information is handled in accordance with those laws and any separate privacy notice we provide to you in connection with the applicable relationship, which will control over this policy to the extent of any conflict.
13. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top. Your continued use of the Site after changes are posted means you accept the updated policy.
